Little Wild Things - Terms & Conditions

THE CLIENT

1. I/We the Client, Understand that Little Wild Things Babysitting Referral Agency, allocate and arrange the Babysitter in accordance with the details provided on the booking form filled out by us the Client.

2. The $40 standard booking fee and $50 wedding booking fee is not refundable but can be transfer table depending on availability.

3. I/We have received, read and understand the Agency and Babysitting price list, which has been confirmed for our assignment on payment of the booking fee provided.

4. The Agency fee applies per booking, per sitter. This may be quoted at a different rate for multiple day bookings.

4a) Sessions must be booked for a minimum of three (3) hours, and four (4) hours during peak holiday periods and public holidays. Sitters must be paid for the minimum booking period even when the actual period of the Session is less.

4b) In the event that the minimum Session is not fulfilled, the Customer must still pay the Sitter the full amount otherwise payable for the minimum period.

5. The details and times listed form part of this agreement and I/We agreed to make every effort to co operate in order for the Agency and Babysitter/Nanny to fulfil its contractual duty. I/we acknowledge the Agency cannot accept responsibility if these details are incorrect or if I/We chose not to follow the agreed to schedule.

6. To avoid disruption to the Babysitting duties and to allow the Babysitter/Nanny to fulfil its contractual duty; only the number of Children originally detailed may be cared for.

7. If any additional children are left with the sitter without informing the agency with at least 24 hours notice, (other than specified in the booking), the sitter may leave with 30 minutes notice to me/us by phone and or text message. I agree that all ratio's of sitter's to children are to be strictly adhered to as indicated by Little Wild Things Baby Sitting, are in the best interest and safety of the children and the sitter looking after them.

8. The Babysitting/Nanny fee is payable to the babysitter in cash upon completion of each job. Including travel fees if they apply. If this does not happen an administration fee of $50 will be payable to Little Wild Things Baby Sitting.

9. I/We agree and understand that all start times and finish times for the Sitters and Nannies are legally binding. Late fee's are payable should the Sitter or Nanny be at the property after the agreed to finish time (unless otherwise agreed to in writing). Late fee's are calculated in 30 minute blocks and are double the original sitting rate per hour.

9a) Customers agree to pay any reasonable parking costs incurred by the Sitter.

10. Should I/we fail to pay any Babysitting/Nanny fee within fourteen (14) days of notification of completion, the Agency shall charge 20% per month on the unpaid balance. In addition, I/ we acknowledge that no future Bookings will be accepted until the Babysitting/Nanny Fee is paid in full.

11. I/We agree to disclose any and all medical concerns and or recent illnesses that the children to be cared for have been diagnosed with or symptoms that have been present, especially in the previous 2 weeks. In the case of children that are and have been unwell, the Sitter can use their expert judgment and if needed call for medical assistance. The Sitter/Nanny is not a medical professional (they do hold current first aid) however they have no responsibility as to determining health issues with any of the children being cared for. If the Sitter/Nanny is concerned, they have my permission to call an ambulance.

12. Medical Consent. In case of any medical emergency, I authorise the Sitter who is caring for my children to consent to medical emergency treatment that must be rendered. This treatment being rendered under supervision and advice of any emergency medical person or physician if I cannot be contacted. Any expenses incurred during treatment are my responsibility.

13. Cancellation Policy. I, The Client, agree that should I cancel my booking less than 24 hours prior to the agreed booking, a cancellation fee will be payable to The Agency. The cancellation fee is equivalent to the minimum 3 hour contact time as agreed to when confirming The Booking.

14) It is a condition of this Agreement, and using Little Wild Things Babysitting Services, that the Customer shall not contact any Sitter directly in order to engage their Services. All booking's must come directly through the agency.

15) We have a strict NO driving policy. Our babysitters will not drive children around. If transport is needed to and from event's such as wedding's please organise a taxi or Uber for your children.

THE AGENCY

1. The price quoted will be guaranteed, otherwise the current price will be confirmed when the booking fee is paid. Any additional costs will be advised and confirmation required before proceeding.

2. All Babysitters will have appropriate and up to date First Aid and WWCC (Working With Children Check).

3. The Agency and Babysitter/Nanny shall carry out this assignment with due and professional diligence.

4. If a Babysitter/Nanny is sick or fails to show up, the Agency will refund the booking fee.

5. (a) This Agreement shall be subject to and constructed according to the law in NSW, Australia and the parties agree to accept the exclusive direction of NSW Courts.

(b) No variation of terms and conditions set out here in shall be effective unless agreed in writing by both parties.

6. The Agency is not responsible for any misconduct displayed by a Babysitter/Nanny.

7. Liabilities and warranties. Babysitters are independent contractors, and Little Wild Things Baby Sitting is not liable for any damage, injury or loss suffered as a result of the Sitter’s actions. We conduct a thorough interview and screening process before allowing a Sitter to be registered with us, however we do not make any warranties as to the
